However, the church register lists Schnyder. Or Schneyder. Or Schnider. And on the passenger list of the ship that took him to South America, it became Snaider. This is not an isolated case. Until well into the 20th century, there was no uniform spelling for surnames. Civil registrars, pastors, port officials, and immigration authorities wrote down what they heard – and that depended on dialect, mother tongue, and handwriting. This is precisely what becomes a problem for your application to establish German nationality: If the name in the archive records is spelled differently than in your application, the BVA cannot establish the connection between generations without further ado. Why name variations are a real obstacle in archive research The Federal Administrative Office (Bundesverwaltungsamt - BVA) in Cologne requires at least one birth certificate for each generation in the lineage and, ideally, proof of German nationality. Munich Higher Regional Court: Buyer can be bound by a long-term commercial lease – even if the seller was not the landlord themselves
The Munich Higher Regional Court (OLG München) made a practically relevant decision for commercial tenancy law with its order dated 08.07.2025 – 32 U 3124/24. The focus was on three typical points of contention in long-term commercial lease agreements: the entry of a property purchaser into the lease agreement, the interpretation of a handwritten agreed lease term, and the question of whether the rented property was sufficiently defined. The decision is particularly important for landlords, commercial tenants, buyers of commercial properties, and property managers. It shows that a purchaser cannot simply terminate an existing commercial lease agreement through ordinary notice of termination if the contractual structure was economically oriented towards the owner and the contract contains a sufficiently defined long-term commitment. The case: Purchaser wanted to terminate the commercial tenant In the case decided by the Munich Higher Regional Court, premises were leased for the operation of a food retail business. The landlord was not the property owner himself, but a general partnership (OHG). According to the court's findings, this interposition of a partnership was tax-motivated. The lease was granted with the consent and in the economic interest of the owner. Later, the property was sold. The purchaser gave ordinary notice of termination of the commercial lease agreement and demanded the vacating and handover of the business premises. The commercial tenant objected. She invoked that the lease agreement stipulated a fixed term of ten years and could not be terminated by ordinary notice. The Traunstein Regional Court dismissed the eviction claim.
