Residence permit in Germany according to § 4 para. 1 AufenthG

According to § Section 4 (1) Residence Act (AufenthG) a residence permit in order to enter Germany legally and stay here. Residence permits are divided into four categories:

  • VisaSchengen visa or national visa - § 6 AufenthG
  • Residence permit - Section 7 Residence Act
  • Settlement permit - Section 9 Residence Act
  • Permanent residence permit-EG - Section 9a AufenthG

These residence permits differ in their requirements and their period of validity. The choice of the right title depends on the purpose of your stay, such as marriage, work or study.

Visa types: Schengen visa and national visa

Schengen visa

A Schengen visa authorises entry and stay in the member states of the Schengen area for up to 90 days within a period of 180 days. It is issued for tourism purposes, business trips or visiting friends and family.

National visa

A national visa on the other hand, is required for longer stays (over 90 days). Typical use cases are

  • Taking up studies, training or work in Germany
  • Family reunification, including spouse reunification and marriage visas
  • Stays for other longer-term purposes, such as research or voluntary services

The national visa is often the first step towards applying for a Residence permit or Settlement permit.

Procedure and requirements for marriage visas and subsequent immigration of spouses

Marriage visa (national visa) pursuant to Section 6 (3) AufenthG

A Marriage visa is a national visa issued specifically for the purpose of marriage in Germany. It allows the foreign partner to enter Germany to get married within a certain period of time and then apply for a residence permit.

Requirements for the marriage visa:

  1. General requirements (§ 5 AufenthG):
    • Securing a livelihood
    • No threat to public safety or order
    • Valid passport
  2. Special requirements:
    • Proof of the intention to marry by confirmation from the registry office
    • Declaration of commitment for the period between entry and marriage

The marriage visa is usually issued for three months. In exceptional cases, the validity can be extended if the marriage is delayed.

Disadvantages of a marriage visa

  • The processing time is often lengthy due to the necessary coordination with the registry office.
  • During the period between entry and marriage, a declaration of commitment is required.

Spouse reunification with Germans in accordance with § 28 Para. 1 No. 1 AufenthG

The Spousal reunification is relevant if the marriage has already taken place and the foreign spouse wishes to move to Germany permanently. Unlike a marriage visa, a declaration of commitment is not required here, which makes the process easier.

Requirements for the reunification of spouses:

  • Proof of basic German language skills (A1 level)
  • The German spouse has his/her habitual residence in Germany
  • No grounds for deportation or security concerns (e.g. terrorist threat)
  • The entry regulations were complied with

A decisive advantage is that the spouse's livelihood does not necessarily have to be secured, as Article 6 of the Basic Law (protection of marriage and family) has special priority here.

Rights in the case of spousal reunification

After successful entry, the foreign spouse is entitled to:

  • Residence permit according to § Section 28 Residence Act
  • Access to language courses and integration measures
  • Opportunities to take up employment in Germany

Marriage of convenience: risks and legal measures

The suspicion of a Marriage of convenience often leads to the refusal of a visa or residence permit. According to Section 27 (1a) AufenthG, a marriage is categorised as a marriage of convenience if:

  • The marriage was entered into solely for the purpose of entry or residence
  • One of the spouses was forced to marry

If the authorities wrongly assume that the marriage is a sham, you have the option of appealing against the decision or taking legal action.

Proof of basic German language skills in accordance with § 28 Para. 1 No. 1 AufenthG

Basic language skills (A1 level) are often a hurdle, especially for spouses from countries without access to German courses. Exceptions to this requirement are possible, but rare. Possible reasons for an exception:

  • Proof of repeated failure to pass the language test despite intensive learning efforts
  • Existence of a health impairment that makes learning impossible

If the embassy or foreigners authority sets the requirements too high, this can be legally challenged.

Legal remedy

Legal remedies in the event of rejection of a visa or residence permit

If an application for a visa or residence permit is rejected, there are various options available. Legal remedy available:

1. remonstration

One Remonstration is a written objection to the decision of the embassy or consulate. The case will be re-examined and additional documents or evidence may be submitted.

2. action to compel

If the remonstration remains unsuccessful, a Compulsory action be submitted to the Berlin Administrative Court. In many cases, the visa is only authorised following a court decision.

3. urgent application (interim injunction)

If the visa application is particularly urgent, a temporary injunction can be applied for to oblige the embassy or authority to process it quickly.

4. action for failure to act

If the processing time exceeds three months, a Action for failure to act to force the authority to make a decision.

      Although you are a German citizen, you do not have the same entitlements as a natural-born German citizen... The immigration authority can also reject the declaration of commitment or the visa application because your income is not sufficient... For you as a naturalised German, the same requirements apply as for the settlement permit. If there is a case of hardship (legal action), you can even assume that you will be required to live abroad... (because you are naturalised and not born German).

      You must cover your husband's expenses and provide sufficient living space.

      In short, your ID card does not protect you !!!

        1. If you have sufficient funds, I would apply for a Schengen visa and then get married in Denmark. Then have the marriage registered and the wife can stay in Germany. It took "only" 3 weeks between the application in Armenia and the granting of the visa! They live in Cologne. Perhaps this is an advantage, as all documents from the embassies first arrive in Cologne and are distributed from there.

    My registered partner and I have been back together in Germany since 10/07/13 after a year's separation. One week later, we submitted an application for a residence permit or extension to the local immigration office. He already had a residence permit before the separation, but this expired after he left for Chile. Now, as a Chilean tourist, he is only allowed to stay in Germany for 20 days (his 90-day period of stay expires on 10 September 2013) and we are still waiting for the residence permit to be issued
    What would happen in the worst case scenario if his residence permit was not issued in time before the 90 days? Would he then have to leave Germany and return after three months abroad to submit a new application? Or would he be allowed to stay here beyond the 90 days as my registered partner and in view of his then valid residence title, e.g. with a special visa until a new final title is issued? Unfortunately, the Immigration Office is very sparse with information and, in my view, does not inspire confidence. Many thanks in advance for the much appreciated answer to my questions

I can't find a job myself but have found a job for my husband in Mannheim. I myself live in Hanover where he has a monthly net income of 1,700 euros. You first have to pass the a1 german test in kosovo and provide proof, once you have passed this test you can apply to the embassy in prishtina to join your spouse, this can take up to 3 months until your wife gets an appointment at the immigration office in Germany where she has to provide proof of her livelihood and a rental contract. Good luck, I've been through the same thing for a week now and luckily my husband is allowed to come to Germany 🙂

    1. No, they can't do that!!! I'm talking from family experience. When my parents came to Germany about 20 years ago she was pregnant and they wanted to deport my family. Fortunately, my parents got to know German people here with whom they got on well and they got a lawyer and said that it's not possible to deport a pregnant woman! And certainly not if you got married here legally.
      You can rest assured, but it's best to contact a lawyer immediately.

    My wife, who I married a year ago, has been living with me in Germany for 4 months now.
    Like everyone else, she had to take an A1 German test at the Goethe Institute in her home country (Pakistan) and prove it to the German Embassy in Pakistan, which she did and after which she received her 3-month visa.

    Now, when we wanted to apply for a residence permit in Germany, the immigration authorities here in Hanover started to ask her highly complex questions which under no circumstances can be understood and answered by a person who has just passed the simple A1 test.
    As she could not answer all the questions, she was only given a fictitious certificate and given an appointment 3 months later.
    Now she has failed this German test on site again and she has been given another appointment shortly before her fictitious certificate expires, which is in about 1 month.

    Now my question:
    Her classmates from the Goethe-Institut who also came to Germany didn't have to answer any questions and each received a residence permit without any problems except my wife, and I also did a little research and didn't find any information about a German test that was asked again in Germany and I haven't heard of anyone who had to pass a test again here just to get the residence permit.
    So the whole thing doesn't seem quite right to me and I was also told that "there will be problems if it doesn't pass again next time".
    Everything happened at Der Ausländerbehörde Hannover like this.

I also recently got married in Turkey and my husband is in the process of proving his German language skills at the Goethe Institute. Unfortunately, many candidates have difficulties passing this test. I can only advise you to study online with your husband despite the language course. It is quite difficult for someone who is completely unfamiliar with the language to learn German at A1 level. The exam consists of 4 parts: Listening, reading, writing and speaking. Order the book "Deutsch als Fremdsprache/ Zweitsprache - Miteinander, Deutsch- Türkisch" online and send it to him by post. It contains 4 CDs. We got married in India in 2016 and the priest and the court there did not register our marriage as a Special Marriage Act, but also registered me as a Hindu, which meant that our marriage was registered as a pure Hindu marriage and not as a Special Marriage Act.     I married my wife in Kosovo in Dec. 2018. Beforehand, we had all the documents notarised (apostille) and the translations arranged. The whole thing was very expensive for me, but I covered all the costs. Now my wife had an appointment at the German embassy on 4 October 2019. There she was linguistically checked by an employee of the German embassy. Everything went really well, as my wife and her family lived in Germany until 2001 and she also went to primary school. However, they returned to Kosovo voluntarily after the Balkan conflict.

    After we have submitted all the applications and other formalities, we are waiting for the national visa, spouse reunification, to be issued. My wife rang the embassy last week to enquire about the status of things and was told "you are not the only person waiting for your visa". A crass answer and not answered!

    Once again, I had sent a few emails to the embassy and got no reply. I called the embassy earlier, after what felt like 5 minutes I was on hold and then they just hung up on me. I called them again and selected the option 1 on the keypad of my smartphone (visa enquiry). It was already 10 a.m. and an automated voice said "We are available for visa enquiries from 9 a.m. to ......? Laughable what are they doing? It is NOW 10:10 am!

    I called the Foreign Office in Berlin on Friday. The employee at the visa centre told me that something was still being checked because of Schengen, blah, blah, blah. He wasn't allowed to tell me any more because of data protection!

    My wife was in Switzerland illegally a few years ago. Now I'm worried that she won't be allowed to join me in Germany. Switzerland has nothing to do with Germany, but because of Schengen, could we be framed for it or not? She was not in Germany illegally! We also got married of our own free will and conviction.

    Question, am I panicking for nothing or what should we do in general? How long will it take after the appointment at the embassy for my wife to receive the national visa to join my spouse? I am invoking Article GG 6, but that doesn't seem to interest them at all. Moreover, 9 weeks have already passed since the said appointment? I also wonder why they can't give us an approximate time frame?

    Unbelievable and I am a German citizen and taxpayer! And this is how they handle my money! All employees in the embassy live from our tax money! And you can expect to get concrete information!

    Condominium
    Severely disabled at present from GdB 70 (70%) Application for aggravation is currently in progress (100% with mark B, BL G, H and RF)

    My wife (Bosnian-Herzegovinian) and I got married in a civil ceremony in Cologne in January 2019. She has been living here since then and has not passed the A1 because she has difficulties. Unfortunately, I am also 80% blind and hard of hearing. She has now received a fictitious certificate until 1 April 2020 to pass the A1 German course.
    Unfortunately, it is very difficult for her to cope with this, as she manages all her private tasks almost exclusively on her own. That means she looks after me, accompanies me, goes shopping alone etc.. She doesn't receive any social welfare etc..

  110. Hello, I was born in Germany and got married in Egypt in April 2019.
    We waited 6 months at the embassy for an appointment and then we submitted the application. The application was then sent to the immigration office in December 2019. I had to provide my employment contract, 12 payslips, my tenancy agreement, a certificate from my employer and permission from my landlord for my husband to live with me. I had a 134 square metre flat for 2 people. At the beginning of January 2020, I had everything together and handed it in directly to the authorities. Then came corona. In February 2021, the immigration office then took action, but unfortunately they hadn't received my message that I had moved, I have to say I had cleaned there for a while, I know the conditions in there. In any case, they thought I was in a sham marriage and had written to the old address that I should submit chat protocols, but I didn't receive these requests because I hadn't lived there for half a year. As a result, we received a rejection in September 2021 with the reason that I could not be reached and suspected fictitious marriage. I then immediately submitted a remonstration and after 2 years the embassy realised that the UL we had submitted for the A1 was not valid after all, but I asked several times and everything was fine. We then submitted the necessary documents and on 24.01.2022 an info was sent to the old authority that the documents should be sent to the new one. I then called after 6 weeks but the UL were not yet there, I sent an email to ask them to send the UL over and now I can no longer reach anyone and there is no response to emails. What can you do if you can't afford a lawyer? I can't even calculate how much it will cost, so far I've always been told 500 to 600 euros at best, but it could be considerably more. I would be grateful for any advice because, as you can see from the text, it's been going on for a long time and I don't know what to do.

  111. Who is responsible for issuing a residence permit *after* marriage? Can/must a new residence permit based on the new marriage be applied for/issued via the local immigration authority even without a previous departure requirement & new visa?

    I, German, live in Germany, she third-country national, currently lives/registered with me, entered with visa & residence title for recognition purposes, limited title "expired", since ~October only fictions (still valid, but shortly before expiry, in total ~2Y with corresponding residence in DE). Application for extension submitted "in some way", but currently rejected verbally as not possible, written hearing to come soon. In the meantime, the decision to marry has been made (soon in Denmark, with re-entry via existing fiction). Leaving for a third country just to apply for a new visa there, which is to be granted, seems "pointless" or harassment.

      The procedure is as follows:
      Declaration of commitment at the immigration office
      German birth certificate not older than six months (original)
      Copy of identity card or passport
      Partner abroad needs in Original:
      Declaration of no impediment to marriage and birth certificate both with apostille and translation into German by a translator certified by the Higher Regional Court.
      Copy of passport valid for at least six months
      Take all the documents to the registry office and apply for marriage registration
      Send to partner abroad after registration has been granted
      Appointment at the German Embassy
      Proof of basic German language skills at level A1 is required. Proof must be provided by
      Presentation of a language certificate (Goethe-Institut, telc GmbH, TestDaF)
      Declaration of commitment by the fiancé(e) from Germany.
      Registration for marriage at a German registry office (i.e. the examination
      of the registry office has been finalised, a marriage date has been set)
      Passport copy of the fiancé(e) living in Germany.
      Completed application for the issue of the visa
      Waiting time depending on the embassy (e.g. Venezuela 8 to 10 weeks)
      Obtain a visa and then go to Germany to get married, then take the certificate to the immigration office and apply for a residence permit.
      It took us a total of 9 months, nothing to do with Denmark or other games because that makes people suspicious and despite the marriage certificate the partner has to leave the country and apply for a visa there.

    My fiancée and I would like to apply for a marriage visa for her. I am a German citizen and she is a foreigner (not EU). However, we would marry in church in her home country shortly before entering the country. The marriage there would have to be legally binding. We have registered the marriage at the German registry office, but after entering the country we would cancel the marriage at the registry office in Germany.

    The reason for this is that we would like to be together immediately after the wedding and would not have to be separated from each other for a long time after the marriage and wait a long time for a "spouse reunion" visa to be issued.
    At the same time, we would have to celebrate the wedding in church in her home country (that's where it takes place) so that her family could attend.

    My cousin with Turkish roots, born in Germany with German citizenship, got married in Turkey. His wife has to complete the A1 language acquisition programme for family reunification. His wife is finding it really difficult to learn and has already failed the exam for the third time. I'm sure it won't get any better the next time either. The fact that this is her prerequisite for living here in Germany with her husband makes her sad and puts her under extreme psychological pressure. Is there a way around this or generally another way that the two of them can finally live here together?

    My wife and I got married in Thailand in September, everything went according to the regulations of both countries, marriage certificate, consular certificate, legalisation of this, wedding at the registry office, marriage certificate and extract from the marriage register translated and legalised by the German embassy.     I am a German citizen, a good year ago my wife and I got married in Turkey (Turkish citizens || I have dual citizenship, but was born in Germany).

    Now we are in the process of family reunification - the whole thing is being handled for the German representation in Turkey by a service provider (iDATA), which distributes the appointments to the visa applicants for the consulate according to capacity.

    Here is the first point - after a telephone enquiry, after my wife had collected all the necessary documents (including the language certificate (ÖSD A1), which is only valid for one year), she was told that an appointment can only be made after 10 to 11 months (!!!) - then another few weeks until the visa is applied for and already more than a year has passed - in my opinion absolutely unreasonable.

    My second question is whether we have the option of applying for a national visa for family reunification while we wait for the reply, so that we can at least spend 90 days together here during the waiting period. What are the chances of this? Would our chances be better if we tried to do this by legal means?

      Yes, in my opinion the long waiting time is unlawful and constitutes a violation of the applicant's rights. The Federal Foreign Office, as the employer of the embassies, should take remedial action here. And yes, you can also apply for a Schengen visa while waiting for the national visa. This is possible and also beneficial for the national visa.

Now about 8 weeks have passed and the ABH has contacted me and requested proof of income, an employment contract and information about my living situation. I only have a mini-job with a net income of €600 (otherwise I live off my private assets). Why am I being asked for this when it is not normally necessary? I am now worried that the application will be rejected because of my low income. Is that possible?

    I have already handed in a VE with just under 2000 net and that was no problem, but on the internet you can read about marriage visas with well over 2000 net, I read about 2700 for Hamburg. That worries me, only the team leader or higher earns that much here and I'm not a poor bastard, just a normal mid-level employee.
