For the employer’s right to initially declare the termination based on the approval notice, it is irrelevant whether the approval is overturned by the objection committee or a court, as long as the respective decision is not final and binding.

When determining the timing of vacation, the employee’s vacation preferences must be taken into account, unless urgent operational reasons or the vacation requests of other employees, who deserve priority based on social considerations, conflict with them. Vacation must be granted if the employee requests it following a medical care or rehabilitation measure.
